Given the UK, Belgium or Switzerland, the exiled French tax is a godsend. Or rather a client to conquer. On this lucrative market, the election of Francois Hollande whets the appetite. Two measures of the new president – ISF and heavier taxation to 75% of revenues in excess of 1 million euros – may scare away more French taxpayers. The British intend to benefit and say it bluntly. "I think a number of terrible French will want to come to London", welcomed Iain Duncan Smith, the British Secretary of State for Labour, just before the victory of Francois Hollande. The English press is full of testimonials from real estate agents London noting an influx of French.

In fact, in France, tax lawyers perceive an increase of candidates for exile. "I treated a dozen applications for three months against six to eight per year once," says Corinne Dadi, a lawyer with Stehlin & Associés. Two hold the rope destinations: the United Kingdom and Switzerland. The two countries have for them the absence of ISF and tax regimes for foreigners: package negotiated with the IRS and soldant all taxes, Bern, and exemption of income not repatriated to Britain, to London . "Both countries outside the euro area, which reassures those who doubt the future of the single currency," says Marc Vaslin, associate lawyer at Scotto & Associates. Indeed, the banks of the Thames and Lake Geneva are not really competitors. Would not that because the beneficiaries of the Swiss tax package should not work in the country. "London is a cosmopolitan city for working executives. Those who go to Switzerland are rather retirees who enjoy the climate and security, "says Christophe Chaillet, director of engineering heritage HSBC France.

Swiss Secrecy

Especially, unlike the English, the Swiss authorities are playing the card of discretion. The government is doing everything for the country to get rid of the label of tax haven payday advance. In addition, a portion of the population Helvetian, supported by the left, opposed the package. Reason: local citizens pay, themselves, suffer heavy taxes and the housing boom caused by tax exiles. The canton of Zurich has abandoned the system of lump sum taxation, and a petition to that effect circulated in Geneva. "This petition does not certainly result. But the trend is upward packages to avoid becoming too unpopular and are removed, "said Marc Vaslin. Not enough, however, lose its attractiveness to Switzerland. "The country has sound public finances, which is reassuring for the long term," said Corinne Dadi. The fact that the British government takes a liberal policy is also an appreciated.

In contrast, Belgium, heavily in debt (public debt reached 98% of GDP), has now less popular among the candidates for the tax exile. "My clients are concerned Belgian tax increases," says Corinne Dadi. "I would not be surprised that the gains of less than five years end up being taxed. But the exemption of capital gains is the main attraction of this country, especially for those selling their businesses, "adds Marc Vaslin. As for Spain, it came out the exiles from radar screens, due to recovery of the ISF and economy in crisis.

Anyway, the decision to leave France is often painful. This is why lawyers are also working on schemes that will allow their French customers not to be too adversely affected by future tax measures.

The "Spring of shareholders" in the City made a victim. Andrew Moss, head of the British insurer Aviva, resigned Tuesday after suffering a historic setback against his compensation during the general assembly of the firm last week. He might himself have abandoned a planned increase of 4.6% of annual salary of 960,000 pounds (1.2 million), shareholders with 54% disavowed his remuneration package. Taking note of this humiliation, he chose to retire to try to appease the revolt. Aviva's action was immediately flown more than 5% at the London Stock Exchange.

The fat cats ("fat cats"), as they are called here, hug the walls in the European capital of finance. For months, wages at six or seven zeros and their bonuses are exponential in the hot seat. Shareholder activism, biased against remuneration unrelated to performance in crisis, the disapproval of public opinion and government voluntarism in this area combine to send the message to the bosses Taking arrived.

In the same day on Tuesday, the Chief of the bookmaker William Hill, Ralph Topping, has narrowly escaped facing a turbulent AG which voted 49.8% against the salary increase of 8.3% and a bonus of 1.2 million pounds. A small carrier angrily denounced "the feast of the last chance for CEOs who try to take as much as possible while there is still time."

Last week, Sly Bailey, the leader of the newspaper group Trinity Mirror, has also resigned rather than having to face this Thursday the shareholder revolt over his salary of 1.7 million pounds, while the action of the company lost 90% of its value since she took control.

Bill

Friday, it was the turn of the leaders of energy giant Centrica to face the challenge of a package of 4.3 million pounds intended for his boss, Sam Laidlaw. This agitation is not the fact of radical activist shareholders. Large institutional investors now lead the protest. 32% of those of Barclays Bank have opposed or abstained on the 17 million pounds of CEO Bob Diamond and 2.1 billion of bonuses distributed in the house, three times the amount of dividends paid.

"The shareholders have lost patience exasperated, says Sarah Wilson, leader of the association of small shareholders Manifest. This is not a political movement but the requirement for better business performance. The occupation movement of the London Stock Exchange has legitimized the need for state regulation since the boards were not able to regulate itself. "

A bill will be presented precisely this Wednesday's Speech from the Throne. One of its most controversial provisions, however, may be abandoned: it planned to require the approval of compensation plans for a three-fourths majority of shareholders. But the law should make the vote binding general meetings so far merely advisory.

Meanwhile, the "Spring of the shareholders' only budding. The association of retired FairPensions has launched a campaign for all retirees, widows Scottish kind, make their voices heard against excessive compensation. English executive salaries jumped 49% in one year.

Some 757,515 iPad (at $ 499 each) or even 33 years of compensation of Jeffrey Immelt, the boss of General Electric: The New York Timess'est amused to calculate the envelope that represented outstanding $ 378 million, attributed to Tim Cook, Apple chief executive in 2011, the equivalent of 42,000 dollars an hour. Given the recent surge in Apple stock, this package, largely in restricted shares for at least five years-would be $ 634 million

.

Needless to say, the successor to the boss Steve Jobs is the most spoiled of the United States by its board of directors. According to research firm Equilar for The New York Times, the 100 best-paid bosses of the United States have pocketed a total of last year's $ 2.1 billion. An amount up 2%. On average, each CEO earned $ 14.4 million.

The second, used the charts, Lawrence Ellison of Oracle, has earned $ 77.6 million. The third with $ 53.3 million, Ronald Johnson, who arrived this fall at the head of department stores JC Penney, is a newcomer. In fact, the distributor, for debauch the star of Apple, had to compensate by offering shares JC Penney instead of securities of electronics giant that it could reach if he resigned. A bad deal, so far: the Apple shares would be worth nearly $ 160 million, against less than 60 million worth of JC Penney.

To combat the excesses that contributed to the financial crisis of 2008, Congress passed a reform that pushes for more transparency on the remuneration of bosses and gives shareholders more weight on the determination of these envelopes, containing cash, bonus and stock options.

After Marseille last October, Air France is launching 18 new routes in Europe and the Mediterranean from Nice and Toulouse. Air France-based aircraft to 10 8 to Toulouse and Nice with the aim of winning 600,000 and 250,000 passengers in Toulouse to Nice. The French company decided a year ago to be placed in the low-cost launching an offensive in the regions, particularly to counter easyJet, its rival, which has also recently opened two new bases … Toulouse and Nice.

But for easyJet, the development of the company is simpler to implement, "one is born low cost, it does not become so" amused himself last October François Bacchetta, its chief executive. Indeed, Air France, move to low-cost model implies big changes: we must be more responsive, increase the productivity of aircraft, reorganizing the work of hostesses, stewards and pilots, who will now fly more on fewer days, and reduce costs.

Orly soon affected by the reorganization?

However, in Toulouse – where ten new destinations in Europe (Athens, Berlin, Hamburg, Malaga, Malta, Naples, Prague, Seville, Venice and Vienna) and four (Casablanca, Istanbul, Marrakech and Tunis) are proposed – of Such changes are not appreciated by the employees of Air France. The CGT denounced a "deterioration of working conditions related to a much lower recruitment to the increase of activity planned." According to a senior manager quoted by the Journal du Dimanche, the new organization could receive Orly Airport: "This is an assumption on which the board working group on the short and medium haul."

The company, which reported in 2011 some 800 million euros in losses, hired in January a plan of savings over three years (2015 Transform), to € 2 billion savings and reduced debt 6 to 4,000,000,000 euros.

France is hardly served in international rankings in education. Only four of its representatives are emerging among the 100 institutions classified Thursday morning by the Times Higher Education (THE), a British weekly known for the seriousness of its rankings. France ranks as the seventh largest in the world.

The Paris-Sorbonne University is located between 71st and 80th place of the second international league based on "reputation". It occupied the 91st place last year. Then comes the Polytechnic, which ranks between 91st and 100th place. This year, two new institutions enter the prestigious list: the University Paris-Sud (Orsay) and the University Pierre and Marie Curie (Paris VI), both beyond the 91st place.

"France is well represented in these tables, with four institutions in the top 100, more than Canada, and more than double the number of representatives of China. But the country's authorities should be concerned that such a system of higher education with a long tradition of excellence has its highest ranked institution beyond the 71st, well behind the leading institutions in England and Germany "by Phil Baty, the head of the ranking. And the specialist to wonder: "Maybe the current reforms in the French higher education will they do the difference in the longer term, but for now there is much uncertainty and confusion about the French system, which can affect the country's reputation among scholars throughout the world. "

A "business" full

The study measures the reputation of excellence in both teaching and in research by 117,554 educators from 137 countries. Given a choice between 6000 and institutions were asked what were the best institutions in their field of specialty. The issue of reputation is important in the era of the internationalization of education, as universities compete with each other to attract the best students. And they are buying more and more a "brand" when they enroll in an institution. It has become a "business" in its own right, according to THE.

The first six of the classification, called "super brands" in the study because they crush all others because of their notoriety, are again American universities Harvard, Massachusetts Institute of Technology (MIT), the English university of Cambridge, two new American, Stanford and Berkeley, and Oxford. These universities' dominate the head and shoulders above the other institutions, "the study said.

The U.S. dominates with 44 institutions which are among the first hundred, ten are British, and five are Japanese. Five others were Dutch. Followed by Germany, Australia and France, each with four institutions.

Health professionals, yes; traders, no. Traditionally, pharmacists refuse to be mistaken for "grocers". Yet their compensation depends only on the amount of drugs they deliver: a fixed sum per box, plus a percentage of the sales price. But that should change soon. Unions of pharmacists and Medicare are conducting a negotiation whose term is scheduled for March 28 and whose objective is to diversify their earnings. They should soon receive a "fee" valuing their missions of prevention, screening and support for patients in their treatment.

While pushing the profession to move in that direction. Looking for savings to Social Security, the State declining year by year the prices of reimbursed medicines. This is the pharmaceutical industry is concerned, but pharmacies are affected indirectly. Meanwhile, the volumes go up more slowly than in the past, indirect consequence of the case Mediator, who chipped patients' confidence in medicines.

Pharmacists work so many years to expand their role, or indeed, to recognize and pay duties they already perform more or less informal. Governments are receptive, because they see a partial solution to the deserts medical (drug stores are well distributed across the country) and the size of firms. The law "Bachelot" of 2009 formalized these missions. The 2012 budget of the Safely authorized their remuneration. The current negotiations must make it happen.

Two types of innovations are planned. Of "dispensing fee", first, that rémunéreront the advice given by the pharmacist when dispensing drugs. Magnitude discussed: 1 euro or 1.50 euro for each prescription. The sum could be modulated, for example by age of patient (an increase for the elderly or babies, often complex cases).

Then, a compensation of each pharmacy on efficiency targets (issued by generic) or public health. This is probably clarify the terms of this last part that the majority of work still lies ahead. A bonus could be given to pharmacies that always deliver the same brand of generic chronic, especially seniors, to avoid confusion in the treatments.

Pharmacists could also meet regularly with patients taking anticoagulants, which are at risk of serious interactions with other drugs, or treated with Subutex (substitute for heroin), to adjust their dosages. These "interviews pharmaceuticals" – no question of using the word "consultation" so as not to upset the doctors – would be paid to the unit or by an annual amount per patient monitoring. They would take place as part of a treatment protocol, a contract for three, doctor, patient and pharmacist.

Purpose of trade unions of pharmacists and FSPF USPO: 25% of revenues from these new compounds remuneration within five years. The negotiation will determine the share of these amounts between Medicare and complementary, participating in discussions. Above all they must fix the total amount of the budget allocated to pharmacies. Medicare, with limited financial margins, would the same. The unions are demanding an increase comparable to that of total health expenditure, or 2.5%. Essential, they argue, because there will be Winners and Losers in pharmacies. But their situation has weakened in recent years. One hundred pharmacies close every 22,000 years: a marginal phenomenon but unpublished.

The puzzle dental fee

Friday, dentists Liberals, too, began a negotiation with Medicare. The CNSD majority union, hopes to pay for guards Sunday and alignment of the consultation fee to that of physicians (23 euros against 21).

But both parties are under no illusions: because of the leeway of Social Security, they will not solve the main problem for patients, yet they admit both. For decades, the rates for conservative treatment (caries, scaling …) and surgical (extractions …), set by Medicare, are undervalued. Dentists to "catch up" on bridges and crowns, to free prices but poorly reimbursed.

They are happy to try to establish a finer grid tariffs, which will allow the social security and complementary to better understand the activity of dentists … and perhaps to adjust rates during the following convention. They also specify the quote must present dentists, distinguishing manufacturing cost of the prosthesis and other charges, on the one hand, and amount of benefit, on the other.

1 – Under what conditions can we invoke the implied warranty?

The seller remains liable after the transaction, housing defects that were hidden at the time of sale, when they "make the property unfit for the use it was destined or so impair that use the acquirer n ' would not have made the decision to purchase, or at least not at that price, if he had knowledge "(Article 1641 Civil Code). Conversely, the seller is not liable for defects that were apparent (Article 1642). Case law judge and are latent defects: the presence of termites or asbestos in housing, lack of foundation, the existence of underground quarries generating instability of the frame, the lack of connection to the public drainage wastewater, or noise pollution caused by insufficient thickness of walls.

2 – The seller may be relieved of responsibility?

The seller can clear themselves by inserting in the deed of sale a clause stating that it will not be required to guarantee the buyer in case of defect. These clauses, found in most deeds, are only valid if the seller is a non-professional and is in good faith. Such is the case, for example, a seller who did not know the day of the sale, the presence of mérules (wood-rotting fungi) in the beams of his house, since the diagnostic technique that had commissioned was not one mention.

However, the vendor apparent bad faith can not invoke this clause, for example when he blocked and painted floors and baseboards to conceal the presence of termites, or has done work to conceal cracks affecting the structure of the frame. Attention, even if the seller does not commit any act of concealment, it can be considered in bad faith when it is aware of the defect and that he did not notify the purchaser.

3 – What might the seller in case of discovery of a latent defect?

If the vendor is found liable for hidden defects by the judge, the purchaser has the option, request cancellation of the sale or reduction of its price (sections 1644 and 1646 of the Civil Code). If he chooses the cancellation of the sale, the seller must refund the purchase price and notary fees. If it chooses a price reduction, it is for an expert to determine the amount. The seller in bad faith can also be ordered to pay damages (Article 1645 Civil Code). Attention, the action in warranty against hidden defects must be brought within two years after the discovery of the defect (Article 1648 Civil Code). It is the vendor to prove that the discovery of latent defects occurred more than two years before the introduction of the lawsuit.

Good news for fans of Whoppers. Fifteen years after leaving France, Burger King returns. According Procos, the federation of specialized retail chains, the giant fast food restaurants will soon open in the new commercial center of the Gare Saint-Lazare. Moreover, according to our information, the sign should also open this year on highway: its first store could be located in Reims, on A4 or on the ASF network which also operates the A 9 between Avignon and Perpignan A 7 or the south of Lyon. Representatives of the sign would also contacted APRR, which operates, among others, the A 6 between Paris and Lyon. But no contract has been signed so far with this network, making it impossible to open before 2013. In the latter two cases, the brand of gas stations Avia would manage these concessions.

Questioned, Burger King recognizes continuing study opportunities to develop in different countries, including France. But his spokesman refused to give more information. Side of Autogrill, which manages 75% of the restoration of St. Lazarus, the CEO in France ensures that Burger King does not open on March 21 for the opening of the mall from the station, nor later than 2012 . The time is propitious yet. "The expenses of the French in fast food rose 4% last year, said Christine Tartanson, Foodservice Director at NPD Group. This is one of the segments of the fastest growing food. Burger King should take into account consumption habits of the French, by proposing a sweetened offer in addition to burgers. "

A few weeks before Christmas, a doll sold by the chain Toys "R" Us "wreaks havoc across the Atlantic to the point that offended parents rushed to the site of the company to request that it be removed at the earliest of the sale. For, they say, the doll that is part of a set of triplets do not babble as usual by spelling his name does not twitters saying hello, do not cry when she feels lonely. No, this doll … jure. And what rough way!

To listen go to a child who takes her in his arms, is believed to actually hear the words crazy bitch (bitch sort of) in his babbling. Enough to jump to the families who let go on the website of the company and called for a boycott!

"Do not buy!"

"Return the dolls, boycott Toys" R "Us, outraged Sue, of Tulsa (Oklahoma, south) on the website of the chain of toys under the picture of the doll."I'm outraged," exclaims also a grandmother of triplets from Boise (Idaho, north-west). "My girls were 2 and a half years, I do not want her to hear such language,".

"Do not buy," recommends his side Danyelle, Fayetteville (North Carolina, South East) who said he checked with six different people that the doll angelic promise indeed.

A spokeswoman for U.S. Toys "R" Us, said the doll is sold in the United States did not swear, and it was only a "babbling." "We will not sell obviously not a doll swear, "said Jennifer Albano, adding that the brand of toys did not intend to withdraw from the sale.

This is not the first time that toys are controversial within days of Christmas.
